{"id":965,"date":"2015-08-21T11:04:29","date_gmt":"2015-08-21T15:04:29","guid":{"rendered":"http:\/\/www.bakertillyvantagen.com\/?p=965"},"modified":"2023-05-09T14:33:26","modified_gmt":"2023-05-09T14:33:26","slug":"employers-denial-of-aca-impact-could-cost-them-a-fortune","status":"publish","type":"post","link":"https:\/\/sitepreviews.org\/bt-vantagen\/965\/employers-denial-of-aca-impact-could-cost-them-a-fortune\/","title":{"rendered":"Employers\u2019 denial of ACA impact could cost them a fortune"},"content":{"rendered":"<div class=\"entry-body\">\n<p>In all of my dealings with employers on Affordable Care Act (ACA) matters since 2010, I\u2019ve reached a few reasonably sound conclusions.\u00a0 Here\u2019s one: employers are faking it!\u00a0 They are doing so when it comes to how IRS controlled group rules influence the ACA\u2019s \u201cApplicable Large Employer\u201d (ALE) determination.\u00a0 It is this determination that serves as a foundational component of the ACA\u2019s Employer Shared Responsibility (\u201cpay or play\u201d) mandate.\u00a0 To recap, employers of 50 or more full-time equivalent employees (100 or more for 2015) are expected to offer ACA compliant coverage (play) or pay assessable payments.\u00a0 The amounts of these payments are based on factors that include the number of full-time employees and how many of them qualify for Exchange-based premium subsidies.<\/p>\n<\/div>\n<div class=\"entry-more\">\n<p>I know this because when they ask, and I explain, how to determine whether they are considered an ALE, they react in one of three ways:<\/p>\n<ul>\n<li>They nod and walk away \u2013 never to be heard from again.<\/li>\n<li>They say, \u201cOh, then I\u2019m good, because we had to look at that when we set up our retirement plan in 1999.\u201d<\/li>\n<li>They don\u2019t believe what they are being told and contact someone else for a second opinion.<\/li>\n<\/ul>\n<p>It\u2019s only been in a handful of occasions where I\u2019ve seen our employer clients request a bona fide assessment of the group and its membership.\u00a0 What this tells me is that while many employers haven\u2019t ignored the need to do their ACA\/ALE homework, they have stopped short of double checking their work.<\/p>\n<p>That may have been all well and good for the initial pass at ACA compliance.\u00a0 However, now looming in early 2016 is the ACA\u2019s new reporting requirements.\u00a0 The draft forms issued by the IRS signal the employer\u2019s need to have a mastery level understanding of its controlled groups \u2013 to the extent they can even report to the member level.\u00a0 One form asks the question: \u201cIs ALE Member a member of an Aggregated ALE Group?\u201d\u00a0 It\u2019s a simple answer: yes or no?\u00a0 Much less simple is whether or not the employer will be able to pull the data that supports this answer, as the IRS will come to expect.<\/p>\n<p>Employers have many other considerations to make when it comes to this new reporting requirement.\u00a0 However, at its core, the reporting is intended to mechanize much of what the ACA requires when it comes to who has coverage, who is eligible for coverage, who is being subsidized by the taxpayers for the coverage they have, and why.\u00a0 Employers, whether ALEs or not (and whether they like it or not), are part of the \u201cwhy\u201d factor.\u00a0 The reason?\u00a0 Because employers of all sizes directly influence why a portion of the population is granted access to \u201caffordable\u201d coverage by way of federal subsidies.<\/p>\n<p>So if you faked it the first time around when it comes to your ALE determination, now is the time to get serious and do the double check.\u00a0 Contact your trusted advisors and have them run the appropriate test.\u00a0 Document it so you can back up your ALE and group health coverage positions.\u00a0 With penalties that can run up to $1.5 million per year, the price to pay for faking it could be huge.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>In all of my dealings with employers on Affordable Care Act (ACA) matters since 2010, I\u2019ve reached a few reasonably sound conclusions.\u00a0 Here\u2019s one: employers are faking it!\u00a0 They are doing so when it comes to how IRS controlled group rules influence the ACA\u2019s \u201cApplicable Large Employer\u201d (ALE) determination.\u00a0 It is this determination that serves [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[],"class_list":["post-965","post","type-post","status-publish","format-standard","hentry","category-blog"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.8 -
